WASHINGTON (AP) - The government on Thursday decided that songs delivered online by Internet music broadcasters will be charged royalty fees at a rate that is half of what was originally proposed by an arbitration panel.


Librarian of Congress James H. Billington, who oversees the U.S. Copyright Office, found that the original proposal setting a higher rate "was arbitrary and not supported by the record of evidence," said spokeswoman Jill Brett.

Instead, webcasters will be charged at a rate that amounts to 70 cents per song for every 1,000 listeners, the Copyright Office announced on its Web site.

In May, Billington rejected the panel's rate proposal — up to $1.40 per song heard by 1,000 listeners. That was double the rate for broadcasts sent out simultaneously on radio and the Internet.

The recording industry, which had sought higher royalties to compensate artists and music labels for using their songs, criticized the lower rate.

The rate "simply does not reflect the fair market value of the music as promised by the law," said Cary Sherman, president of Recording Industry Association of America.

Even though many webcasters had sought lower rates, some were still unhappy.

"We're going to lose more money," said John Jeffrey, vice president of Live365 Inc., the largest Internet radio network. "We think that this is a rate that still means the majority of independent webcasters will cease to operate."

Jeffrey said even the lowered rate will still cost the cash-strapped company about $100,000 each month.

Live365, a network composed of about 30,000 radio stations created by individual Internet users, wanted a rate based on a percentage of revenue, the same scheme used to pay songwriters and music composers.

Opponents to Thursday's ruling can appeal to the U.S. Court of Appeals for the District of Columbia Circuit within 30 days. The court could modify or set aside the decision if it finds the ruling was highly unreasonable.

Internet radio — either simulcasts of traditional over-the-air radio or Internet-only stations streamed through the Internet to computers — is becoming more popular as people get high-speed connections at home.

Webcasters said the rates initially proposed were too high and would cost larger Internet radio broadcasters hundreds of thousands of dollars annually, more than they get from advertising or listener contributions. Many webcasters said the fees, which would be retroactive to 1998, would force them to shut down.

The new fees would add to the royalties already paid by webcasters who, like over-the-air radio stations, already pay composers a rate typically based on a percentage of the broadcaster's revenue.

Traditional radio broadcasters have been exempt from paying the royalties for each song played — the standard that is now being applied to webcasters. Broadcasters successfully argued before lawmakers that they already were promoting the music.

After the recording industry failed to impose new royalties on traditional broadcasters, the industry turned to webcasters — and a 1998 law granted the industry its wish.

Can we all do ourselves a favor and NEVER BUY A GODDAMN CD EVER AGAIN???? These fucking companies rape us thru our pockets year in and year out and now they find a new way to stick it up our ass. File sharing will never end, it will keep moving from new program to new program. I suggest everyone only use them and to hell with the record companies.....make it hurt where it hurts most. Let the record companies feel the sting of a cattle prod going up their ass for a change.

If these fees are too high I might have to shut down. SU is a great thing but honestly I am already shelling out $15 a month for the right to broadcast and I can't justify spending more on what is really a hobby that does not create any revenue of it's own. Are there any other options to live365 out there? With all the CARP issues it seems that internet radio is really going to take a huge hit and maybe even kill it off.

I don't thik Live 365 will be hurt in the near future by the carp shit. The fucked up court system that allows appeal after appeal may actually have some kind of benefit now.

I hope so....but either way Live365 is jacking up their fees.....the word is the price can go up 20-30 bucks more on top of what people already pay for the service....and as we all know SU is not exactly legal....so we now have to deal with the extra fees and the scrutiny of what we play on our feeds.

i'm not sure about anyone else, but i'd be willing to kick in a few bucks for the cause. (of course i would hope that nobody would solicit "donations" like tampaxradio). i've been sponging for a while, this may be a way to help out people like chuck, sblue, av8er, and all others who stream for us nothings.

Wow....today Live365 released their new charges that will cover all of the CARP charges for the broadcasters. Word around the campfire was that the price could be between $20-30 more. In a shocking but suprising move today Live365 announced that the charge for all broadcasters would be only $5.00!

Although streaming audio is a little more convenient, You're forgetting USENET! It's free, always will be. check out alt.binaries.sounds.radio.misc, even loveline shows are posted there! The only problem is the dude that posts O&A on that newsgroup doesn't know how to lower the bitrate on his mp3's which results in huge files.

My point is: If live365 gets too expensive, Just upload your stuff to Usenet!

And might I mention that those files found in those USENET sites are shitty real audio files and are 30 minute clips at a time.

Thanks for the welcome, I was told about this type of behaviour here, I really didn't expect it on what I thought was a helpful reply.

I mentioned Usenet because your post stated that live365 was in trouble, I was mearly posting an alternative. I Download O&A, Stern and Loveline from Usenet daily. When you have the whole show on mp3 sitting on your computer, You can listen to it whenever you want. I also have a car stereo that plays MP3's, It's nice to be able to Listen to O&A when going on a trip or something.

Sorry for replying to your post. I posted because I thought you could do a better Job than the current Usenet O&A poster. I guess your an AOL user and Don't have usenet access. Sorry to offend your apparently small mind.

BTW, I download O&A in MP3 format off of the usenet group in my previous post. At a bitrate of 128kbs, the sound quality is better than your streaming audio. Yes it is posted in in multiple files. I like it that way, Makes it easier to skip certain parts while in the car. A 6 track O&A CD plays continuous without interuption BUT gives me the option to skip a segment ahead if I don't like the guest on the show that day.

In closing I'd like to say Fuck You.

I PRAY live365 and other sites like it go down the tube due to the royalty fees, What will be left? FTP and USENET. I'm sure everyone wants to pay out their ass for FTP bandwidth.

I saw a post by sblueman freaking out because he didnt have a days show on mp3, he was waiting for a few of his friends to email him the bits and parts they had, I guess he didn't know about alt.binaries.sounds.radio.misc If he did, he would have had the show.
