Mayor Giuliani yesterday declared war - again - on more than 100 sex shops, trying for a second time to shutter strip clubs and porn theaters, while slapping stricter rules on X-rated video and bookstores.
Giuliani unveiled a get-tough amendment to his sex-shop zoning law that would effectively eliminate or curtail 101 of the city's 136 sex businesses.

It would close 36 topless clubs and 36 adult movie houses - many in Manhattan - that have been able to keep operating for the past three years under a special rule.

The crackdown also would affect 29 video and book stores, forcing them to wall off areas where they sell sex materials to ensure customers are not exposed to an X-rated eyeful of products when they walk into the store.

"The law has been successful but it's run into a problem," Giuliani said.

"Sex shops can no longer evade our system of regulation through sham compliance.

"Since we started, we've reduced the number of adult establishments dramatically, but we have 51 new ones that have developed and of those, 26 are in impermissible locations."

The mayor's proposal would close a "loophole" used by strip bars and porn theaters and also would give city zoning inspectors more leeway in deciding whether a sex business was out of compliance.

While the number of adult businesses has declined dramatically in Manhattan over the past eight years - from 107 to 69 - it has stayed almost the same in the outer boroughs, where there are 67.

Only 21 strip clubs, eight theaters and six bookstores -- which are zoned in nonresidential areas - would be allowed to remain open under the mayor's plan.

"We're at war again," said Herald Price Fahringer, a lawyer for more than 100 sexually explicit businesses.

Under the so-called "60-40" rule, adult video and book stores in residential areas may remain open if 60 percent or more if their products are not X-rated.

Giuliani is going after the strip clubs and porn theaters that have interpreted the rule by dedicating 40 percent or less of their floor space to go-go dancing or sex products.

The mayor and Planning Commissioner Joe Rose would prohibit the 60-40 rule from being used by strip bars. Rose said 36 theaters that feature either live or videotaped entertainment, such as peep booths, also would have to be closed under the amendment.

Giuliani's proposals also would allow inspectors to consider factors other than the 40 percent rule while deciding whether to close the shops and clubs. The criteria would include taking into account the prominence of the display of sex-related items.

Several sex stores have given little more than lip service to the 60-40 rule, stocking dusty shelves with old kung fu movies and instructional videos in order to comply with the law.

The city has lost twice in the state Court of Appeals in decisions that upheld the 60-40 rule.

Giuliani will again face strong opposition from Fahringer's coalition should the amendment become law.

"The state Court of Appeals has held that nude dancing is constitutionally protected, so to simply ban it in most places is preposterous," Fahringer said.

"As usual, the mayor is not concerned with the First Amendment, and that's sad."

All four of the Democratic mayoral candidates said they supported the mayor's plan.

Whenever I hear about Rudy and Sex, the only thought that comes to mind is "What a dick!"

Doesn't he understand that part of the appeal of NYC is the "edginess" of life here? Goddamn, why doesn't Cleveland or San Antonio get the same attention as NYC? I'll tell you, because they don't compare and one of the reasons for that is that you can find ANYTHING here.

Good job Rudy, what's next? I think it's time to crack down on the hot dog vendors again.

sex sells, sex is life, sex will always be the biggest money maker in the world and it harms no one.

Back to the days of prehistoric man we can find pornographic etchings on cave walls. To the romans and the ancient chinese cultures to even today sex is everywhere and one of the biggest chunks of society of any country.

What upsets me is that people who fight against pornography, you'd think they never had sex or watched porn.

Who does is hurt? what about the daily violence on television? And i don't mean in movies i am talking about the media.

Take the clinton scandal of a couple years ago. The media and parents all complained that "how are we supposed to explain what oral sex is to our children?" well i don't remember bill clinton on TV talking about sex. The media kept it in our faces and on TV and Magazines every single day for years.

Drugs,Violence and shitty parenting not sex hurt children. if these people spent more time raising their kids rather than deciding what is good for them and lobbying against porn then maybe we'd be a better society. Parents don't want to take responsibility for their actions. Don't blame society for your kids problems blame yourself.

I was rasied with no parents, i had an abusive childhood. I was surrounded by drugs, alcohol and death my whole life. But my grandmother raised me and made sure i didnt watch certain things and she explained things to me and was never embarassed to talk to me about sex, or drugs or anything and she raised me proper. I have never touched a drug and never Plan to. I rarely drink only when i am out i do not enjoy alcohol. I always did well in school and i have never encountered many problems such as with the law nor school. Not cause i didnt watch porn or was shieled from things but because someone taught me.

When did you ever hear of a child watching a porno then killing someone? They won't cause they watch porn jerk-off all over themselves and they are happy and these kids don't shoot up schools.

Let's bring back all the crime while we're at it. I prefer Times Square the old way, full of drug dealers, pimps, and hookers. It was fun riding the subway when you could look forward to gettting chains snatched or your wallet lifted.

Guiliani is NOT repsonsible for the crime rate going down. The police commisioner who was in place when he first took office (drawing a blank on the name now) put into effect a large number of policies, procedures, etc. to inrease the effectiveness of the police. Giuliani didn't like the guy so he fired him and put in someone else, but the new guy just continued the porgram that Giuliani is taking credit for.

Giuliani did NOT clean up Times Square. TS is a B.I.D. (Business Improvement District). There are several throughout the 5 boroughs. BID were created by investors, developers, and business people working together to revitalize these areas and make them more profitable. The BID's asked Giuliani for a way to move the sex shops out of TS so they could move in. Giuliani just seized the opportunity and is taking all the credit.

Giuliani is another two faced politician who is capatalizing on the good work of OTHERS to help the city to both make himself look good and to further his own CONSERVATIVE agenda.
