The man in CA who started the fire is now accussed of murder because of 2 planes flying overhead that were trying to put the fire out collided and they died.

For me this is a strech of the murder law. This guy may be a big piece of shit but The firemen are all there by choice. No one said if you dont go and put the fire out you will be punished. It was an accident. Thier deaths were a tradgedy but this guy being charged with murder for thier accident is just a bit much for me.

What do you think? What is your opinion?

Nah, this guy SHOULD be charged with murder. Think about it, yes it was an accident. But if this fuck never started the fire, then they wouldnt have been there. Thus then no accident.

You state that they are they by choice. Yes, this is true, but they're there to protect you tool. Remember? And anything we can do to protect them, should be done. Firefighters are completely underrated (no i'm not one, and don't personally know any either). But I'm glad they're there to do a job that I wouldn't want to do. It's a dangerous job, yes, but I think that ANYONE that starts a fire, and someone gets hurt in the fire, should be responsible.

Murder charges will NEVER stick, but MANSLAUGHTER might.

Murder means you INTENDED for people to die. The "degrees" refer to how much planning was invloved.

Manslaughter means the death was accidental, but it was your fault, your actions, that caused it and it was preventable.

Sorry NewFan, but I gotta go against you. This asshole who started the fire should get the murder charge - even though as Dent said he'll probably get manslaughter. Most firemen that I know don't wake up every day and say "Hmmm, I can't wait to go put out some fires!". These guys put themselves on the line for people like us every day. Yes, they chose to do this kind of work as a career, but its a NOBLE choice. The planes colliding was an accident, sure - but they wouldn't have been there if this assfuck hadn't started the fire. There should be a law called "the Domino Effect" where you get charged based on the results of what you did - no matter how indirect the results are.

In a way, that's the rule. As long as there are no intervening events that break the "chain of causation." It doesn't matter if the defendant anticipated the results or not.

I don't know the rules for California, but this guy may be guilty of a lesser degree of murder ("reckless indifference to an unjustifiably high risk to human life"), or more likely involuntary manslaughter (gross negligence resulting in death). In case you were wondering...

HUH - you are now blaming the victim for being at the wrong place at the wrong time.
1) Robbery/hold up = Felony
2) Homicide while in commission of a robbery/holdup/carjacking = Murder

Mashed...you're 100% right. I don't know if there is a law like this in California, but if someone dies as a result of another felony that you comitted it is definitely a murder. Not premeditated, but murder nonetheless.

Manslaughter is unintentional - like if I wasn't really paying attention while driving and as a result I ran over and killed an old woman. I was negligent in not paying attention, but there was no intent on my part to either committ a crime or cause injury. Manslaughter is also a common plea bargain that people charged with murder take with the DAs because that is the only way the DA thinks that they will do any jail time.

Doesn't matter if it was an accident or not - the cause of death is/was a direct result of the initial action.
