Murder is murder. When you commit such a heinous crime as that you should be punished like an adult.

that little girl was way too badly injured for this to have been an accident. fractured skull, broken ribs, and we're expected to believe he did this with wrestling moves that he believed wouldnt hurt her? I'm glad they locked him up. By the age of 12, he should know the difference between playing and murder.

But there is a difference between premeditated murder and unintentional manslaughter. Both should be punished yet there should be different variations to them.

If you change the defendant's age to 18 (or 28 whatever)would it make the crime any less heinous?
If he were older, don't tell me people wouldn't be calling for his head.

A first degree murder charge is harse, don't know if the jury was given the option of manslaughter (which is what I feel it should have been). I may be mistaken, but I thought I heard somewhere there was a possible plead bargain before the trial.

At age 12, SOME people don't have a sense of what is life and death, but they SHOULD KNOW the difference between right and wrong.

The boy's attorney wants Broward County Judge Joel Lazarus to overturn the conviction or, at least, reduce it from first-degree murder when he is sentenced March 9.

The defense argued at trial that Lionel, then 12, was imitating professional wrestling moves he had seen on TV when he accidentally killed Tiffany Eunick in July 1999.

The prosecution contended that Lionel intentionally beat Tiffany while his mother baby-sat the girl, who suffered more than 30 injuries, including a lacerated liver and a skull fracture.

Prosecutor Ken Padowitz said Friday he wanted the judge to uphold Lionel's conviction but said he would ask Gov. Jeb Bush to commute the boy's sentence.

He said that before trial Lionel and his mother rejected a plea bargain of three years in a juvenile prison, a year of house arrest and 10 years of probation and counseling.

Mark James, Tiffany's father, asked the judge to uphold the conviction and impose a life sentence.

``Lionel Tate is not a victim - my daughter is the victim,'' he said.

You can't treat a 12 year old as an adult, because he's not. Think back to when you were 12. How grown up were you? Are you an adult at 12?

Yeah, the kid did wrong, but you don't kill him, or lock him up for the next 50, 60, 70 years.

If you think 12 year olds should be treated as adults, than should they be able to get a drivers license? Buy booze? Join the Army? Vote?

HOW FUCKKIN' STUPID IS THIS LADY? A state trooper that had NO knowledge of the law/consequences of the crime? UN-FUCKIN-BELIEVBLE

I read the news article also, which didn't get the play that the sentence itself got, which describes the injuries, and let me tell ya, those injuries DO NOT come from a single act. On first glance the sentence appears harsh, but based on whats been written about her injuries, that girl was beaten, no, pounded to death. Even if it was a reckless act,(which I doubt) anyone that fucking stupid does not belong in society.

I think the parents should join him
at 12 we knew when we were hurting someone
When we were play wrestling if someone got hurt
which was like a sore arm or something we knew to stop or slow it down.
As for blaming Wrestling, dont think thats the kid talking

onedisturbing part is that this standard is not given out to everyone who commits murder. this kid knew wtf he was doing. and non of that crying on tv shit. how much crying do you think that helpless girl did while she was being pummeled.
andd this crap can't be blamed on wrestling that's bullshit, the kid is solely accountable

In Florida, the min sentance for 1rst degree murder is life, without parole. The little shit was convicted of 1rst degree murder. If they don't like the law, change it. Personally, I think it is a sad statement about parenting. If this little shit was worth his weight in fromunda cheese, his actions would have been different. Unfortunately, I question whether someone who has been brought up with so little regard for life, can ever actually unlearn it. If he can, there is always commuting the sentance, but it would take an awfull lot to convince me a change has been made for the better.

Give the fucked up twat of a worthless mother the life sentance and put the kid into intense psychological rehab untilhe's 18, that seams the fairest way to me. BTW Jeb Bush loves his law and order image to much to ever commute a sentance.

Wow Guys aloto of good points this is why I said it was hard for me to stnad on either side. One thing I do know is that there was a loss of life. One mother lost her daughter forever and nothing anyone can do will bring her back.

The Tate maother still has her child, thats three peoples lives that are shot for good. not to mention those close to these people. This world has gotten outrageous,and people have to learn that their kids need to be controlled. When my kids act up They get smacked, I dont play these Timeout bullshit tactics. Now I don't beat the holy hell out of them but they get a smack for what they did wrong. This is what kids need they need Guidance and structure. they need to be told right from wrong. Explain to your kids what death is what its about what happens when people die and what happens to the people who kill them. Around the age of 11 kids should be taught this. In school and at home.

In this country we base to much o age oh your to young for this your to young for that. Please in Indian cultures and tribes kids are Men at 14. They start having children of their own.

What blows my mind now is the fact that in reality it looks like this kids mother put him in jail for the rest of his life, not the court system. Did she realistically think that he would walk away free as a bird without having to take any responsibility for his actions? The more I keep on reading about this case, the more confused I get about how I feel. One part of me feels that he should rot in jail for the rest of his life, because I am sure that she did at one point say "Stop, you are hurting me." But then there is another part of me who sees him as a 12 year old child who needed someone there to teach him right from wrong. Where was his mother t tell him that wrestling is dangerous and that these people are professionals? I know that when I was younger my parents always made sure that I knew the difference between fiction and reality. Now his only chance of eventual freedom lies in the hands of Jeb Bush, and to be frank the outlook does not look good. You have to feel bad for this kid in a way, but then there is a part of me happy to know that this kid will never walk the streets and be a risk to the children I one day hope to have.

I can't believe that one badly executed wrestling move could cause all of those injuries...I still think there is more to the story then what is being told...that poor little girl suffered more than 30 injuries, including a lacerated liver and a skull fracture...what the fuck is wrong with some parents!

The boy was babysitting the girl from what i understand.So i would think that the parents of the girl were'nt home.And the whole wrestling defense is a bunch of crap.The kids lawyers thought it up.Remember lawyers worse than AIDS

Last night I saw the 2 lawyers involved in this
case on TV. The kid's lawyer is an idiot. The DA
offered a plea bargain. 3 years in jail, 10 years
probation. The kid's lawyer should have told him
to take it.

I'm no doctor, but I'm pretty sure that the bones of a 6 year old are more flexible than the bones of an adult. That said, it would take more effort to fracture and break the bones of a 6 year old than an adult. Most breaks in kids are called "green tree fractures" when the bones bend like a pine tree branch rather than break.

If the 12 year old boy managed to cause that much damage to the 6 year old girl, he was pounding her with no mercy, and definitely not a play act.
