As most of you heard, a few weeks ago I was in a wreck where this drunken assclown hit me almost dead on. We have a court date later on this week, but this guy has a history from what I've been told. He and his lawyers want to settle out of court since he's got a fairly high profile in this town. I've already decided that if we did settle, it would just be for my medical costs and enough money to buy a new car, since my old one is totalled. Some friends have suggested cleaning the guy out, since he makes more in a month than most of us see in a year.

If this had happened to you, what would you do? Clean the guy out, or just get enough to pay off your bills?

I wouldn't "clean the guy out", but, I wouldn't accept "just enough to cover my costs", either.
Go for a little more......he caused you a great inconvenience....could have even cost you your life or, at the very least, permantly handicapped you.

Dude, this guy has a history, and I'm sure he's settled on any prior cases, which is why he is willing to settle on this one. I agree with Luna, don't just go for medical and a car....go for "pain and suffering" and maybe use the fact that you are an active member of the Armed Forces as a little more clout. Get what you can outta this fuckwad, and if its a decent amount, you have some "comfort" money in the bank...what's so bad about that? :thumbs-up:

go for as much as you think you can get....
if you try to clean him out, he won't settle,
ask for a good sum though.
if you just get enough to cover he will not learn a lesson he seems unwilling to learn on his own.

From what I've been told, this guy, who's a lawyer for most of the casinos here in town has used his connections with cops to clear himself before. Most of the cops in Shreveport/Bossier all have second jobs at the casinsos..so it all ties in. I have a meeting with my lawyer tomorrow, so we'll see what happens...

Make the idiot pay. Don't settle for anything less than taking care of yourself for a long time. $250 to $500K over and above a new car and medical costs and your attorney fees. If your lawyer is good, they will get his lawyer to understand that this is a cake walk compared to what they will get if they go to court.

There is a point of just wanting to "cover costs" but you are not taking account the cost of your time, your pain, your life being put in jeopardy, everyone's anguish. This guy owes you much more than a new car and covering medical. You need to be compensated. Don't be hoodwinked by his lawyers and their bullshit. Make sure you have a good lawyer, and really think out this. There is a reason they are looking to settle. I'd make them ante up a good $100,000 over the new car and the medical.

Let's put it this way. If you had died in that wreck, he'd be rotting in prison. Because you lived he gets to walk free and clear?

And, he's done this before? Fuck him! He doesn't want this to go to trial becasue he doesn't want the media getting a hold of it. He doesn't want it to effect his reputation.

Has he lost his drivers license? Is he facing ANY criminal charges for DUI/DWI? How about wreckless endangerment?

If you've got the time and patience, I'd refuse to settle and take it to court just so the media can pick up on it and so criminal charges can be added.

And if you do settle to avoid the headache of a trial, get everything you can.
