Shock Jocks Give New Korn LP Premature Premiere, Perturbing Label

More than two months before the album is officially released, listeners got a feel for the new Korn album Untouchable on Tuesday (April 2), thanks to syndicated radio personalities Opie and Anthony.

The shock jocks, whose four-hour afternoon radio show is syndicated in 18 cities nationwide from New York station WNEW, played four songs from Korn's fifth album, due June 11, at approximately 3:30 ET. After premiering the third, "Tear Me Down," the show's received a cease-and-desist letter from Sony Music Entertainment, parent company for the band's label, Epic, threatening legal action if they continued to play the unauthorized songs.

"If we stopped playing tracks from Untouchable, the new Korn CD, right now because we read that letter, wouldn't we be considered pu--ies?" Opie asked over the air.

"Yup," Anthony replied.

"OK ... This is Korn, from the CD Untouchable. This is 'Falling Through Time.' "

As the track cued up, the sound of tearing paper could be heard. Off the air, Anthony swore it was the legal notice being torn. "It's laying here in pieces," he said.

Thirteen Untouchable tracks, including its single "Here to Stay," had been online via various peer-to-peer file sharing applications, such as Morpheus and Kazaa, for weeks, which is where the station obtained the songs for the broadcast. ("Here to Stay" has been made available for download on MTV.com.)

Other songs broadcast were "Make It Go Away" and "Leave This Place."

Taken together, the four effects-laden songs show a technically developed Korn who favor melody over the unbridled bombast strewn throughout their previous releases, and Jonathan Davis displays a proficiency for gold-throated singing rather than screaming with the intensity to burst blood vessels. The band's signature, downtuned seven-string atmospheres remain.

The reason for the premature premiere, Anthony said, was to infuriate a rival New York station, which disallows their in-studio guests to appear on "The Opie and Anthony Show." When they heard the same station had an agreement to premiere "Here to Stay," the DJs pulled the sort-of early broadcast. The jocks believe more stations will be playing the Korn album as a result of their stunt.

This isn't the first time Opie and Anthony have jumped the gun with a new album. They pulled a similar stunt with Stone Temple Pilots' latest, Shangri-La Dee Da.

Neither Epic Records nor the band's publicists could comment on the incident at press time.

I fully believe this is really, but I don't think Sony(?) will sue them or anything. Hell, I only kind of like Korn, but liked what I heard today and will probably go buy the new album. Nice to see them get covered by MTV.

“The window burns to light the way back home. A light that warms no matter where they've gone. They're off to find the hero of the day. But what if they should fall by someone's wicked way. Still the window burns. Time so slowly turns. And someone there is sighing. Keepers of the flames. Do ya feel your name? Can't you hear your babies crying? Mama they try and break me. Still they try and break me. 'Scuze me while I tend to how I feel. These things return to me that still seem real. Now deservingly this easy chair. But the rocking stopped by wheels of despair. Don't want your aid. But the first I've make. For years can't hold or feel. No, I'm not all me. So please excuse me. While I tend to how I feel. But now the dreams and waking screams. That ever last the night. So build the wall, behind the crawl. And hide until it's light. So can you hear your babies cryin' now? Still the window burns. Time so slowly turns. And someone there is sighing. Keepers of the flames. Do ya feel your name? Can't you hear your babies crying?” - Metallica

MTV did an article on it. That proves what, exactly? Remember, before you answer, Viacom owns both MTV and Infinity.

By the way, there is nothing in that article that says that Viacom and Sony didn't make a deal to play those tracks, so i don't see where the big "proof" is.

You know I heard that they actually got the CD from Korn themselves. It was done in an alley up around 105th st at around 1:24 am the previous night. Awesome Garrett was the go between guy. He hooked up with his hook up, who took him to the alley where a bandmember from Korn, face shrouded in darkness, whose name will not be identified exchanged the code phrases. A car passed by as they stood in the alley remaining, intelligently, quiiet as if nothing wrong was going on. After it was verified the coast was clear the Man from Korn (MfK) reached into a briefcase that was handcuffed to his wrist. Awesome Garrett took out a key that he wore around his neck and inserted it into the lock in the middle of briefcase verifying his identity. MfK did the two code numbers on the side of the briefcase and turned the key. They opened the briefcse and stared at the CD in an unmarked case on a red silk blanket. They stared at it for a couple of seconds in silence when Awesome Garrett took the briefcase attached to his wrist, opened it slowly, nervously with less ceremony since this briefcase was empty to begin with. MfK slowly removed the CD from his briefcase and placed it in Awesome Garrett's. Slowly Awesome Garrett locked his while staring into the eyes of the MfK expecting the deal to go wrong at any moment. His case was finally securely locked. They exchanged nods and the MfK went away first. After five minutes alone in the alley Awesome Garrett looked at his watch and walked out, the opposite way from the MfK and into the limo of none other than Ken Stevens.

After that there were no more details. But we do know that the CD was delivered to the studio so we must assume that everything went according to plan.

Yeah, we all know that the various media, ESPECIALLY the internet, are NEVER vectors for hoaxes and shams.

You people never cease to amaze me. Just b/c something is in the newspaper or on an official website, that doesn't mean that it's true or that some party (in this case, most likely SONY records) isn't behind the story.

Regardless of whether it's real or not (and it's probably not since most of the music industry is just looking for a reason to ban MP3 players and CD burners), who cares if songs were promo'ed on the radio? The label should love that, and, in fact, they send CDs to media long before they're due released. I worked at a newspaper and I can't tell you how many CDs I had before everyone else. PROMOTION...Opie & Anthony....Sony....MTV...

Of course, I could be wrong - it could be real - but if it were real, Sony would already have the lawsuit filed. A company as big as that - bigger than O&A, by the way - would have no monetary or other problem having an attorney draw up those papers in 15 minutes...done. Publicity should be fun and that's all both parities are doing here.
