Thermal Imageing Camera.

Used widely by fire departments, its getting to the point where almost every department in NJ and NY has atleast 1 camera.

Right now there is S going on down in the capital between the FBI and congress on whether or not they may use them for looking into peoples houses, because right now, congress does believe it is an invation of privacy.

There was recently a New York Times article that reported that the Supreme Court ruled that the use of Thermal Imaging devices constituted illegal search and siezure. I don't know the exact date of the article, but it was within the past 3 weeks.

Damn the torpedo's, bite the bullet, go for the gusto, that's what I always say!!! Oh wait...that was someone else. Never mind.

Yes, but then they also ruled, in a recent ruling, that tape recording a cell phone conversation that you over hear due to interference is legal and can be used. Their basis for this was that using any device such as a cell phone, computer and/or cordless phones are prone to interference or can be monitored by outside sources. These risks are taken by the user each time they use these devices and so it is the user's responsibility to watch what is said or done on these devices. Watch out Celebs and Politicians, anyone working for Globe or Enquirer can now sit in your proximatey and tape your cell phone conversations or your neighbor can and sell the tapes to publications such as these.

Seeeeeeems scarey to me, that the office that is suppose to make sure our freedoms are not infinged upon have no problem in giving other's the access to infringe upon our freedoms.

I am very excited to see there's people on this board who read the New York Times and keep up with stuff. I, personally, agree with the idea that thermal imaging letting you see inside houses is a 4th Amend. violation... There is an exclusion in various cases referring to that which is "in plain sight", i.e. you're growing pot in the yard and the police can see from the street, or your neighbor can see from HIS property and informs the police,... or they're walking through your place on an unrelated warrent and see it (within limits,... they cant open the closet looking for a stolen elephant). Following this logic,... no human has the ability to see heat waves from across a wall,... therefore its BAD! [OJ voice] No, no[/OJ voice]

Hope everyone learned a little about their fourth amendment rights today. Want more? The ACLU would be happy to tell you all this to death.

You have to remember that O&A cross all boundaries. There are plenty of very well educated people on this board. I have posted more on this kind of subject than in any other. The other board members bring alternate views of the subjects at hand. Woo-Hoo :)

How about this for a controversial viewpoint on the invasion of privacy that I'm sure will draw some criticism from many members on this board. Allow me first to state that I am a staunch supporter of one's right to privacy.

That being said, most of the challenges against the constitutionality of use of thermal imaging and electronic ease dropping, center around attempts to combat drug trafficking. The war against drugs has forced law enforcement to bend and in many cases break the laws wherever they can. Without the efforts to stop the sale of drugs, the government would not be overly interested in the day to day private activities of most Americans. As the war against drugs continues, the courts and congress will slowly continue to be more flexible in interpretation of the constitution.

So remember, the next time you make that innocent personal purchase from your favorite local supplier, you are feeding the governments desire to find the supply chain at higher levels and they will stop at nothing to find it.

I'm not passing judgement here in anyway, to each there own, but in a roundabout way you are feeding the beast.

Swallow is right...the only reason the government cares about is stopping the drug trafficing. Personally I think there are much more important things to worry about such as global warming (oh wait, thats a myth) or what is wrong with the economy, but the government feels that if you are smoking a little pot in the privacy of your own home and not harming someone that you are the anti-christ and should be put in jail with murderers, so they are going to invade your privacy at every opportunity.

Legally, electronic devices can not be used to observe you when there is a "reasonable expectation of privacy." That includes inside your own home and in a restroom. It is also the reason there are not parabolic microphones attached to CCTV cameras in department stores, parking lots, etc. Because you have a reasonable expectation that when you talk quietly to the person next to you noone else will be able to listen in. But, when you are outdoor, walking the street, on the beach or whatever, you do not have a reasonable expectation of not being looked at. But a camera can not be set up in a restroom or looking through your bedroom window. Unless of course it's a law enforcement agency with a surveilance warrent and even then, they can't put the camera in a restroom. In order to get the warrent, they have to prove to a judge that they have sufficient cause.
