Did The Pinnacle "Horny Goat Weed" people STEAL WOW?
#11
That is such clear bullshit copying of the wow logo. I hope O&A sue their asses. Unless they're getting money for it somehow.

from copyright.gov FAQ:

Short version: no matter if anyone formally copyrighted the logo, from the moment they started printing stickers, they had the rights to the design, and millions of people saw it on the streets, in Crazy Taxi, high above Times Square, etc... so SOMEONE is in a position to either have made a deal with Pinnacle or to sue them.

Quote:HOW TO SECURE A COPYRIGHT
Copyright Secured Automatically upon Creation
The way in which copyright protection is secured is frequently misunderstood. No publication or registration or other action in the Copyright Office is required to secure copyright. (See following Note.) There are, however, certain definite advantages to registration. See \"Copyright Registration.\"

Copyright is secured automatically when the work is created, and a work is \"created\" when it is fixed in a copy or phonorecord for the first time. \"Copies\" are material objects from which a work can be read or visually perceived either directly or with the aid of a machine or device, such as books, manuscripts, sheet music, film, videotape, or microfilm. \"Phonorecords\" are material objects embodying fixations of sounds (excluding, by statutory definition, motion picture soundtracks), such as cassette tapes, CDs, or LPs. Thus, for example, a song (the \"work\") can be fixed in sheet music (\" copies\") or in phonograph disks (\" phonorecords\"), or both.

If a work is prepared over a period of time, the part of the work that is fixed on a particular date constitutes the created work as of that date.

Maybe drinking that stuff will make chicks want to take their tops off.

It could be all part of a master plan.

You know, given the amount of advertsing that Pinnacle did with O&A, maybe their original plan was to have it be the "Official Drink Of The Opie & Anthony Show," but when they kicked off the air and/or O&A told them it was a stupid idea, they just couldn't come up with anything better and just used it.

Anyone actually drink it? Any good?

And speaking of caffinated water, remember when that shit first came out and O&A would brew coffee through it? Ah, the old days.

you know, I am a fan of "conspiracy theories" and that is definitely a solid one.

and seriously though...do you think Pinnacle would have used such a similar logo unless they thought they

A)could get away with it or

B)actually have the rights to use it?

so ultimately, it becomes a question of "who owns that infamous WOW logo"? and also, there has to be some sort of slight alteration so it can be argued in court that the 2 may be similar but may not be the exact same logo.

You know, the Vanilla Ice/David Bowie "Under Pressure" arguement...
