since like you said, governments can't force the church to do anything, governments should not have anything to do with the concept of marriage

There is the State of New York recognizing the union between two people. And then there is the Catholic Church recognizing the union between two people.
In order for the Catholic Church to recognize it, the ceremony must be performed in a church, by a Catholic priest, between a Catholic man and woman who have received all the sacraments of baptism, communion, and confirmation.
